注册MOT须注意时限

问某发展商自行委任律师事务所处理转移协议(Memorandum of Transfer,简称MOT),这名律师在出MOT时还附上发票(Invoice),发票列明如果无法在指定时间内付转移费(Transfer Fees),他们会征收10%的利息。

律师指发展商拖延

我想问,这名律师有权征收利息吗?

我自行找另一名律师处理,一年了MOT还是无法转移,这名律师说是发展商拖延。

我的另一个问题是,MOT在一定的时间无法转移的话会有什么惩罚吗?

答从您的问题而看,我们假设的情况是分层地契已分发后处理的MOT: 

首先,律师是不能征收任何利息的; 

接着,MOT需在指定的时间内被注册,否则将面对的事项如下:

12个月内须签MOT

1.法律规定,发展商需在土地局分发分层地契后的12个月内,签署此MOT;否则将违法。一旦罪成,发展商将面对的后果是:罚款不少过1000令吉;不超过1万令吉。 

2.此外,法律也规定,各单位的屋主也需在收到发展商,发出有关分层地契已被分发通知书后的12个月内,签署此MOT;否则将违法。一旦罪成,屋主将面对以上相同后果。 

3.若MOT已呈上在国家税收局(估价局)评估房屋的最新市价监定下,需缴付印花税数额,屋主需在缴付印花税通知书发出的30天内,缴付此印花税,否则屋主需面对的罚款款项如下:

迟缴印花税可罚款

若屋主在缴付期限届满后的3个月内缴付印花税:25令吉或印花税数额的5%(以较高数额为准) 

若屋主在缴付期限届满的3个月后;6个月内缴付印花税:50令吉或印花税数额的10%(以较高数额为准) 

若屋主在缴付期限届满的6个月后缴付印花税:100令吉或印花税数额的20%(以较高数额为准) 

4.另外,MOT也必需在MOT日期的3个月内,呈交予土地局以注册此MOT。否则,屋主将面对罚款的后果;罚款款项需依据屋格和产业地区而定。

比方说,若产业位于吉隆坡区: 

注册MOT限期期满后所延迟的每3个月可被罚款100令吉;如此类推至到MOT被注册为止;罚款款项最高可达500令吉。 

若产业位于雪兰莪区,罚款款项将依据屋价而定,此罚款款项将会因为延迟时间越长而加倍。

租金收入须缴税

很多人都有房地产收租,但往往忽略了租金收入其实是需要缴税的收入。

有关出租房子若还未缴清银行供款,当中涉及的利息开销,可以用来减免吗?

报税表中只有一栏填写租金收入,那么,这些开销该如何减免?是不是自己必须做一份简单的收支表,加上有关开销的单据作证明?

在呈报租金收入的同时,屋主其实也可以享有一些成本开销的减免(examption),这包括地税、维修费和管理费等。

一提到缴税,一般人都会唉声叹气甚至苦不堪言。为什么人民需要缴税呢?

许多人都自私地认为收入是属于自己的,政府又凭什么来分一杯羹呢?征收税务的目的又是什么呢?

须知政府主要收入来源是来自人民所缴的税,缺少了这份主要的收入,国家就难以取得繁荣。

因此,在所得税法令下,不管是任何国家公民或企业,在国内所赚取的收入,只要是被列为“税务居民”,就有责任将所得的收入缴交税款。

“税务居民” 也称作纳税人,必须清楚申报所得税的期限,以便做好准备向税收局呈上有关表格。基本上,纳税人可分为两种:

选对报税表格

不同种类的纳税人须填写不同的表格。

第一组的纳税人必须在截止日期前呈报所得税表格BE(Borang BE),这一组的纳税人包括非营业社团、只有租金收入者和就业的打工上班族。

第二组的纳税人必须在截止日期前呈报所得税表格B(Borang B), 而这组的纳税人大多从事合伙、合资与独资生意。

对一般打工的纳税人,呈报程序相当直接,加上我国允许纳税人在网上报税,方便又快速。

涉及开销可减免

根据1967年所得税法令第4(d)条例,如果纳税人名下的产业用作出租,从中获取租金收入,该收入属于须纳税的收入,纳税人必须向税务局申报。

虽然如此,政府允许报税人申请税务回扣。

先扣开销只报赚利

简单来说,报税人不必呈报租金总额(gross rental income),应该先扣除涉及开销后,才呈报或填写净租金收入(net rental income)。

这些开销可以包括房屋的维修费、火险和爆窃保费、门牌税和土地税及贷款利息等。

当报税时, 报税人不需要呈上任何收据或相等文件, 不过,报税者则必须把有关资料整理并收存7年。

因为在7年内, 税务局有权力在任何时间、任何情况下要求检查你的资料以作核对。

纳税人应在截止日期前呈报税表格,不然,纳税人就要承担严重后果。

在1967年所得税法令第112(3)(a)条文下被税收局罚款,支付高达三倍的税款。
