储备基金(Sinking Fund)

储备基金(Sinking Fund)的设立是为了应付预期或是紧急维修所需要的费用与支出。

有关储备基金一般设定为管理费的(10%),而管理层必须在每年的屋主常年大会上,向屋主提呈管理费及储备基金的账目的支出与用途。

除了每个月的管理费,公寓管理层定时就会收取一笔储备基金(Sinking Fund)。但几年下来,一直没有看到较明显的提升或翻新,甚至是公寓外观的漆料已剥落,也没重新上漆,围篱被车子撞坏,也没维修好。

应付预期维修费用

储备基金的真正用途包括哪些?居民是否都必须缴付?居民如何查证这些收费的去处和开销?若居民对此感到怀疑或不满,可以如何争取应得的权利?

储备基金的设立是为了应付预期或是紧急维修所需要的费用与支出。储备基金一般设定为管理费的10%,其用途如,在1966年物业发展(控制及执照)法令的标准买卖合约中列明的:

1. 粉刷或翻新任何公共财产 - 从新粉刷公寓外墙是一个典型的例子;

2. 购买与公共财产有关的物品 - 比方为健身室添购新的健身器材;

3. 更新或更换任何公共财产内的配备与器材 – 如更新管理层办公室的电脑等。

2007年建设及共同财产(维持及管理)法令也注明储备基金必须用于以上用途,除此之外,有关法令增加了一个概括条文鉴于管理层权利以定夺储备金的支出。

管理层必须在每年的屋主常年大会上,提呈管理费及储备基金的账目,以向屋主交代所有基金的支出与用途。

如果屋主对有关账目不满或存疑可以要求管理层提出解释甚至向建筑专员投诉。

屋主也可即集体的力量,要求召开特别屋主大会撤换管理层。

公寓保安不靖 可召特大换保全

很多人基于安全原因,偏爱选择居住在公寓,但很多公寓,即使有保安也未必安全。

最近居住的公寓接二连三发生偷窃事件,事主都报了警,但一直找不到人,居民一来怀疑是居住在公寓内的小偷所干,二来更生气保安人员没有做好本份,常让没贴上居民贴纸的车子随意进入。

偷窃案一再发生,证明保安办事不力,居民是否有权要求管理层更换新一批的保全?没有投保偷窃保险的居民,能不能通过法律诉讼,要求管理层或保安公司赔偿?

付了保安费却发现保安人员没有尽责,屋主首先因该向管理层反映此事,以便管理层可以采取行动解决问题。

如果保安人员还是没有作出积极的改变,屋主们可以召开特大,要求撤换保安人员。

如果管理层充耳不闻居民的投诉,屋主们也可以为此事撤换管理层,进而聘请新的保安人员。

关于赔偿问题,屋主必须查看管理层的住屋规则(House Rules)或者居民协议书(Deed of Mutual Covenants)内拥有保安免责声明。

屋主可要求赔偿

如果保安工作由保安公司承包,屋主则可查看保安公司的聘请文件。同样的查阅有关聘请文件是否拥有保安免责声明。如果有关文件没有免责声明同时屋主有足够的证据证明有关损失是因为保安严重疏漏所造成,屋主可以提出法律诉讼要求赔偿。

如果保安问题严重窃贼猖獗,建议屋主加重屋主保安及警报系统同时自行投保,以免损失惨重。
