屋法无边:买屋合约怎么签?

买屋子到底需要拟多少份合约,合约内所需注意的事项有那些?

购买屋子所需要签署的合约,取决于购屋者是向发展商购买屋子或购买二手屋子。

另外,若所购买的屋子是共管社区计划(Strata Scheme)的房屋,那么必须签署有关共管社区管理的额外文件。

(1)向发展商购买

购屋者向发展商购买房子只需要签署买卖合同(Sale and Purchase Agreement)。之前提过,所有向发展商购买即将发展或建造中的房屋(仅限住宅)都必须依照1966年的屋业发展(控制及执照)法令 (简称HDA)的标准买卖合约。

HDA标准买卖合约,基本制定了以下主要条款,购屋者应该仔细检视,以免权益受损:

付款:屋价根据房屋建筑的进度,分期缴付予发展商。

交屋:发展商必须在以下限期内,将房屋移交给购屋者:

(a)土地及建筑:签署买卖合约后24个月(一般的排屋、半独立式洋房及独立式洋房)

(b)分层建筑:签署买卖合约后36个月(一般的组屋、公寓和任何设有共管范围的房屋发展计划)

赔偿:如果发展商逾期则必须赔偿购屋者,赔额根据延迟期限赔及屋价来赔偿。

保用:交屋后的24个月为保用期,发展商必须负责修补任何缺陷,否则购屋者可自行修补再向发展商索回。

索偿:若发展商延迟交屋,房屋手工欠佳或不符合所承诺的建筑规格,而购屋者无法因为这些争议得到合理的赔偿,购屋者可以通过房屋仲裁庭索偿。

如果所购的屋子属于共管社区计划下的房屋,购屋者签署居民协议书(Deed of Mutual Covenants)。

购屋者在签署有关居民协议书时必须注意所需支付的管理和服务费、缴费方式、停车问题、装修规则等。

(2)购买二手屋

二手屋子并非指已有人入住的房子,而是但主权不属于发展商的屋子。

二手房子的买卖属于个别买卖(Sub-sale),购屋者签署主要买卖合同前,通常签署一份购买献意书(Offer to Purchase)。

有关购买献意书列明买卖的主要条件,同时买方必须支付定金以保留有关屋子,直至买卖合同签署。

购屋者可以要求在该献意书内加入特定条件。

比方:如果买方未能在限定期限内获得银行贷款批准,那么卖方必须付还所有定金。



买卖合同产权转让书

买卖双方将签署以下两份主要文件:

1.买卖合同(Sale & Purchase Agreement)及

2.产权转让书(Deed of Assignment)/产权转名表格(Memorandum of Transfer)。

本栏之前提及,二手屋子的买卖合约的内容并不受HDA管制,买卖双方有权自行设定买卖条件以拟定合同条款。需注意条款包括:

付款时限及方式

交屋时限及方式

违反合同的后果

如果屋子与家具一同出售,合同必须附上一份详尽的家具列表,而产权转让书/产权转名表格属于产权转让文件。

如果有关屋子的地契还未颁布,双方必须签署产权转让书,即以合约方式转让有关屋子的所有权益与责任。

如果有关屋契已经颁布,双方则需签署产权转名表格并将有关表格提呈土地局注册产权转名。
